Terms of Service

These Terms of Service ("Terms") set forth the legally binding agreement between you and CaymanCart ("we," "us" or "our"). Your use of the CaymanCart website, mobile applications and related services ("Services") indicates your agreement to be bound by these Terms.

CaymanCart is operated by CaymanCart Ltd., headquartered in George Town, Grand Cayman. All references to CaymanCart below apply equally to CaymanCart Ltd. and its affiliates.

• Account: A user-specific profile created to access CaymanCart features.
• Buyer: A user who browses, enquires about or purchases products or services through CaymanCart.
• Seller / Vendor: An individual or business that lists products, services, deals, events, properties or other offerings on CaymanCart.
• Content: Any text, images, videos, audio, logos, reviews, descriptions, contact details, listings or other material uploaded to or displayed through CaymanCart.
• Listing: A business profile, deal, event, classified, property, excursion, camp or any other published entry on CaymanCart.
• Service: The collective features and functionality of the CaymanCart platform.
• You: Any person accessing or using CaymanCart, whether registered or not.

Our Services are available only to individuals who can form legally binding contracts under applicable Cayman Islands law. By creating an account or using CaymanCart, you warrant that you are at least eighteen (18) years of age and that all information you provide is complete, accurate and current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, whether authorised by you or not. You agree to notify us immediately of any unauthorised use.

Accounts and User IDs may not be transferred, sold or shared with another party. We may require additional documentation to verify identity, especially for vendors, sellers and financial transactions.

You agree to abide by all applicable local, national and international laws and regulations in connection with your use of CaymanCart. You also agree not to:

• Post, upload or transmit content that is unlawful, fraudulent, defamatory, obscene, abusive, threatening, harmful, vulgar, harassing, discriminatory or otherwise objectionable.
• List adult services, adult products or content containing adult material in any form.
• Use CaymanCart for chain letters, junk mail, spam, unsolicited commercial messages or any form of distribution list without express permission.
• Misrepresent your identity, ownership of goods or services, or authority to act on behalf of a business.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Interfere with or disrupt the integrity or performance of CaymanCart or its underlying networks or servers.
• Attempt to gain unauthorised access to CaymanCart systems, accounts or data.

Listings, reviews, comments or messages that violate these Terms may be removed without warning, and your account may be suspended or terminated without refund.

By posting Content on CaymanCart, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, reproduce, distribute and promote your Content for the operation and marketing of the Service. You represent that you own or have the necessary rights to all Content you upload, and that it does not infringe any third-party intellectual property, privacy or publicity rights.

You agree that your listings will be truthful, not misleading, and kept up to date. You may not upload stock or generic images that misrepresent the actual goods, services, location or experience offered. Reviews must reflect genuine experiences; we reserve the right to remove fake, paid, coerced or defamatory reviews.

CaymanCart reserves the right to remove any listing, advertisement, review or other Content for any reason at our sole discretion. We are not obligated to monitor all Content but may review reported or flagged material.

CaymanCart listings, business details, descriptions, images, reviews, pricing, contact information, location data, logos, user-generated Content and all other information displayed on or through CaymanCart are the property of CaymanCart and/or its licensors and vendors.

You may not, without our prior written authorisation:

• Scrape, harvest, mine, spider, crawl, copy, mirror, frame, extract, download, aggregate, cache, reproduce or otherwise collect CaymanCart Content or data by any automated, manual or other means.
• Use CaymanCart Content to build or populate another website, directory, database, application, AI training set, marketing list or commercial product.
• Re-publish, redistribute, sell, license, sublicense or commercially exploit any listing, review, image or other Content obtained from CaymanCart.
• Circumvent any technical measures we use to restrict access to or use of CaymanCart Content.

You may view CaymanCart Content for your own personal, non-commercial use only. Any unauthorised scraping, copying, mirroring, data-mining, extraction or collection of our Content is strictly prohibited and may result in immediate account termination, civil liability and referral to appropriate law enforcement or intellectual-property authorities.

If you wish to use CaymanCart data for a lawful commercial or research purpose, you must contact us in writing and obtain a signed licence agreement before accessing or collecting any data.

The CaymanCart name, logo, taglines, trade dress, software, design, layout, graphics, databases and other proprietary materials are owned by CaymanCart Ltd. or its licensors and are protected by copyright, trademark and other intellectual property laws. You may not use our trademarks or branding without our prior written consent.

Payments for purchases are made directly between the Buyer and the Seller. CaymanCart is not a party to those transactions, does not handle payments in most cases, and is not responsible for setting payment terms, collecting funds or ensuring delivery. Buyers and Sellers must agree on pricing and payment terms before finalising any transaction.

Where CaymanCart does facilitate payment processing for memberships, featured placements, advertising or sponsored placements, those transactions are subject to the pricing and billing terms displayed at checkout.

CaymanCart is not involved in the actual transaction between Buyers and Sellers. As a result, we have no control over the quality, safety, legality or accuracy of listings, goods, services or transactions, and we cannot confirm the identity or age of every user.

To the fullest extent permitted by law, you release CaymanCart Ltd. and its officers, directors, agents, subsidiaries, employees and affiliates from claims, demands and damages of every kind and nature, known and unknown, arising out of or in any way connected with disputes you have with one or more CaymanCart users. If you are unsure about a purchase, sale or agreement, seek competent legal advice before proceeding.

CaymanCart may contain links to third-party websites or resources. We do not control and are not responsible for the content, privacy practices, accuracy or availability of those sites. The inclusion of any link does not imply endorsement or association with the linked site or its operators.

We may suspend, restrict or terminate your account or access to CaymanCart at any time, with or without notice, for conduct that violates these Terms, for fraudulent, abusive or illegal activity, for non-payment, or for any other reason at our sole discretion. Upon termination, your right to use CaymanCart ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including intellectual property, indemnity, disclaimer and liability limitations.

CaymanCart is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, accurate, reliable or free from viruses or harmful components.

To the fullest extent permitted by law, CaymanCart Ltd. and its affiliates will not be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, including lost profits, data, goodwill or other intangible losses, arising out of or relating to your use of or inability to use CaymanCart. Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid to CaymanCart in the twelve (12) months preceding the claim.

You agree to defend, indemnify and hold harmless CaymanCart Ltd. and its officers, directors, employees, agents, affiliates and licensors from and against any claims, liabilities, damages, losses, costs or expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your Content or listings; (b) your use of CaymanCart; (c) your violation of these Terms or any third-party right; or (d) your violation of applicable law.

We may update these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of CaymanCart after the changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using CaymanCart.

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the Cayman Islands, without regard to conflict-of-law principles. For users in the EU or other jurisdictions, additional local consumer protections may apply where required by law.
